§ 154.02. DEFINITIONS.

  • For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
    COMMUNITY ORGANIZATION. A citizen’s group, neighborhood association, neighborhood development corporation or similar organization that: has specific geographic boundaries defined by its bylaws or articles of incorporation and contains at least 40 households within those boundaries, is a non- profit corporation that is representative of at least 25 households or 20% of the households in the community, whichever is less; is operated primarily for the promotion of social welfare and general neighborhood improvement and enhancement; has been incorporated for at least two years; and is exempt from taxation under § 501(c)(3) or 501(c)(4) of the Internal Revenue Code.
    DEPARTMENT. The Building Commissioner and Zoning Administrator’s Office shall be the executive department authorized by this chapter to administer the provisions of IC 36-7-9-1 et seq.
    ENFORCEMENT AUTHORITY. The chief administrative officer of the "department", as heretofore defined, or their designee.
    HEARING AUTHORITY. The Board of Building Appeals, designated as such by the Mayor under the authority of IC 36-7-9-2. The HEARING AUTHORITY shall perform those functions specified by state statute.
    SUBSTANTIAL PROPERTY INTEREST. The definition of SUBSTANTIAL PROPERTY INTEREST set out in IC 36-7-9-2 is specifically incorporated by reference into this chapter as if fully set forth herein.
