§ 94.03. REMOVING EARTH WITHOUT PERMISSION PROHIBITED.

  • (A) It shall be unlawful for any person, individual, firm, association, corporation, partnership, or public utility to take or cause to be taken any earth, stone, gravel, asphalt, or concrete from any street, alley, sidewalk, curb or gutter without permission to do so from the Board of Public Works and Safety.
    (B) This section shall not apply to any person who shall remove the same from any sidewalk pertaining to any lots or property of which the person may be the owner, and necessary to be removed for the purpose of grading or paving the same or for the purpose of constructing a new building or other improvement, permission for which shall be granted by the Council.
