§ 94.01. PERMISSION REQUIRED FOR CONSTRUCTION OR REPAIR.

  • (A) It shall be unlawful for any person, individual, firm, partnership, corporation, association, or public utility to dig trenches in or tear up the surface of any street, alley, or any property under the jurisdiction of the Board of Public Works and Safety, without having secured permission from the City Building Commissioner/Engineer to do so.
    (B) Any person, individual, association, partnership, corporation, firm, or public utility wishing to dig in any street or alley shall make application to the City Building Commissioner/ Engineer for a permit or permission, specifying in the application the name of the party applying, the character of the work proposed to be done, the name and location of the street or alley or other property under the jurisdiction of the Board proposed to be dug up, together with a statement of the exact location of the digging, the object to be accomplished, and the dates of initiation and completion of the proposed construction or digging.
    (C) Along with the application, a bond, approved by the Board of Public Works and Safety, shall be furnished guaranteeing the replacement of all material and the leaving of the streets, alleys, curbs, or other property under the jurisdiction of the Board of Public Works and Safety in proper condition, as determined by the Board.
    (D) The amount of the bond will be of sufficient surety as determined by the City Building Commissioner/Engineer or other person designated by the Board of Public Works and Safety to ensure the proper replacement of all materials.
    (E) It shall be unlawful for any person, individual, firm, association, corporation, partnership, or public utility to excavate in or closely adjoining any sidewalk of this city for building or other purposes without having complied with this section.
    (F) All ordinances of the city prohibiting excavations in the streets and alleys, except by permit prescribing the manner in which the same shall be done, shall apply to the several respective heads of departments of the city and city officers, as well as any and all persons, firms, and corporations.
