§ 35.06. NONREVERTING POLICE SEIZURE AND FORFEITURE FUND.

It is in the best interest of the City of Peru to establish a non-reverting Seizure and Forfeiture Fund within the budget of the Peru Police Department.
(A) The money received based on the forfeiture must be solely for the benefit of any agency directly participating in the seizure or forfeiture for purposes consistent with federal laws and regulations.
(B) The money deposited in the fund will be the Peru Police Department’s pro rata share of the seizure or forfeiture funds distributed by the Miami County Prosecutor’s Office.
(C) The funds can only be used for police equipment, police supplies and other goods directly pertinent to police needs.
(D) The funds may be expended only with the approval of the/an executive, as defined in IC 36-1-2-5.
